We dodged a bullet here

WELL WORN MEMBER
When we moved to Thailand in 2018, our youngest daughter, (7 at the time) didn't have a Thai passport so,
she came in on an Australian passport and, with her upcomming trip back to Aus we were checking her passports etc and
discovered she was technically an overstay.
A trip to immi confirmed this but, because she is still 14, she was given an exemption.
She will be allowed to travel out of Thailand on her Australian passport and when she returns, she will use her Thai passport-----PHEW !!!.
We live and learn.

I don't understand why you think that you had an issue. Surely your daughter has Thai citizenship as a birthright?

She will no doubt have a Thai ID card so getting a Thai passport would be straight forward.

Have I missed something?

Probably my explanation. As she entered Thailand on an Australian passport and not a Thai passport and as this is her first time going
out of Thailand, Jomtien immigration confirmed that she was technically an overstay but, because of her age, she would be exempt---all sorted now.

My point is that a Thai citizen cannot, by definition, ever be on overstay. I think she could have entered Thailand without a Thai passport ....not 100% about that.

I think Jomtien were talking bollocks - or I have missed something obvious?

As always, I am happy to stand corrected...

My eldest Thai daughter was born in England and because of this could not have Thai citizenship.. When we came permanently to live in Thailand in 1986, she, like me had to apply for permanent residency. It was not until she was 17 that the rules changed and she could apply for Thai citizenship, via immigration. As usual, Pattaya immi, corrupt as they were, and no doubt still are, demanded a fee of 100,000THB. Reported it to Immi HO in Bangkok. 2 weeks later, on a Sunday morning, I had an unannounced visit from the Immi Chief to my home and he promised to do what was needed..NO FEE, other than the passport cost. Seems he was spending the weekend in Jomtien with his wife and family and just popped in.

No correction needed @CO-CO. The outcome was positive so, thats all that matters.

Noted.

I only labour the point for the education of readers. It is nice to know what the 'facts/rules' are - and it could save someone an unnecessary visit to an immigration office.

Does anyone really think that what an IO says in Jomtien, or Surin, will have the slightest impact on an IO at his/her desk in Suvarnabhumi?

@FERRET ...out of interest, does Jenay? now have a Thai passport?

Yes @CO-CO, she does hold a Thai and Australian passport.

Home and dry.......... depart Thailand on Thai passport, arrive on Australian passport - leave Oz on Australian passport and arrive BKK on the Thai passport.

Simples.
My wife got some static from US immigration using that method. "But you never arrived there." Now she shows both passports.
