Extending 'permission to stay' at Kap Cheong

In a similar vein to Croc, what is the difference between doing a D.I.Y. project and working? I have made kitchen furniture, wall and floor units, from scratch. Is this working or just D.I.Y.? I have painted the living room, the external walls and fencing, made a veranda wall, landscaped the garden, etc., etc. None of this is done for financial gain, its not for business and is purely for pleasure in retirement. Something to do to keep active. Is there a line that can not be crossed?
 
Could anyone find out what is properly considered "working" in LOS ?

Is harvesting together with my family considered "working" ?
Is cleaning my car or doing the windows considered "working" ?
Is cooking for my family and/or friends considered "working" ?
Is painting my brother in law's house considered "working" ?
Is painting my house considered "working" ?
Is tutoring english to the kids of our family considered "working" ?
Is masturbating considered "working" ?
In every occasion I'm taking up a job a thai could do ... okay maybe not all ...

So what is considered "working" in LOS ... as if I ever saw a thai really "working" ...


You can work on your own house but not on someone else's and sure as hell can not harvest rice even your wife as farming of any kind is a big no no. As for tutoring thats also a no no. Retired is NO FORKING WORK.:D

Your OK and Yes there is a very big line that can be crossed and this is what KCI is saying.
 
It depends on how the IO sees it at the time, Nomad. If it's something that a Thai could do and be paid for, then, yes it could be seen as working. It's then up to you to prove you weren't working by doing all those things you touched on in your post. Did you save money by doing those things yourself...yes!...working!
There is no common sense in this country.
 
Prohibited Jobs for Foreigners in Thailand
A Foreigner can work in Thailand under certain conditions. He or she will normally need a valid visa (some visas exclude working, like a tourist visa) and a valid work permit (there are few exceptions). The main law related to Foreigners working in Thailand is called the Aliens Working Act (B.E. 2521 or 1978) and was recently modified in B.E. 2551 (2008). Foreigners are also restricted to have businesses in certain fields under the Foreign Business Act of 1999.

A Ministerial regulation should be issued before 23 February 2010 to specify what Foreigners (aliens) can or can't do. This date is 2 years after the enforcement of the Working of Aliens Act of 2008.

However, until the new Ministerial regulation, there is a decree made in 1979 which prohibits Foreigners to work 39 occupations. Some of these prohibited jobs were modified or deleted. But at the moment, Foreigners (Aliens) are not permitted to work in the following positions:



  1. Labour work except labour work in fishing boats under the next category below. The said work which is forbidden to aliens shall not apply to aliens who have entered into Thailand under an agreement on hire of labour concluded between the Government of Thailand and other nations, and also aliens whose status has been prescribed as legal immigrant and who possess a residence certificate under the law governing immigration.
  2. Agriculture, animal husbandry, forestry or fishery, except work requiring specialized knowledge, farm supervision, or labour work in fishing boats, particularly marine fishery.
  3. Bricklaying, carpentry, or other construction work.
  4. Wood carving.
  5. Driving motor vehicles or vehicles which do not use machinery or mechanical devices, except piloting aircraft internationally.
  6. Front shop sales and auction sale work.
  7. Supervising, auditing, or giving service in accountancy, except occasional internal auditing.
  8. Cutting or polishing precious or semi-precious stones.
  9. Haircutting, hairdressing, or beautification.
  10. Cloth weaving by hand.
  11. Mat weaving or making utensils from reed, rattan, jute, hay, or bamboo.
  12. Making rice paper by hand.
  13. Lacquer work.
  14. Making Thai musical instruments.
  15. Niello work.
  16. Goldsmith, silversmith, or gold/copper alloy smith work.
  17. Stone work.
  18. Making Thai dolls.
  19. Making mattresses or quilts.
  20. Making alms bowls.
  21. Making silk products by hand.
  22. Making Buddha images.
  23. Knife making.
  24. Making paper or cloth umbrellas.
  25. Making shoes.
  26. Making hats.
  27. Brokerage or agency except in international trading.
  28. Professional civil engineering concerning design and calculation, systemization, analysis, planning, testing, construction supervision, or consulting services, excluding work requiring specialized techniques.
  29. Professional architectural work concerning design, drawing/making, cost estimation, or consulting services.
  30. Dressmaking.
  31. Pottery.
  32. Cigarette rolling by hand.
  33. Tour guiding or conducting.
  34. Hawking of goods & Thai typesetting by hand.
  35. Unwinding and twisting silk by hand.
  36. Clerical or secretarial work.
  37. Providing legal services or engaging in legal work, except arbitration work; and work relating to defense of cases at arbitration level, provided the law governing the dispute under consideration by the arbitrators is not Thai law, or it is a case where there is no need to apply for the enforcement of such arbitration award in Thailand.

Well I think I am well and truly fooked. I think I am in violation of No. 9 - I cut my own hair every day when I shave in the morning and once or twice each month when I put the clippers over my bonce to give myself a N0. 4 crew cut. Will I be deported for being clean shaven?

I'll have to break the bad news to the wife - no can do any longer, GL says its on the forbidden list.
 
Next they will be expecting foreigners to arrive at IO by taxi only, as driving your car is doing someone out of a job!!!!

Not to mention going shopping or making deliveries!

Actually I was in KCI to make my extension based on retirement.

I had to wait 30 minutes for my audience with the big cheese.
He asked if I had anything to say. I had quite a bit to say. He listened and nodded as I spoke for a few minutes on a variety of issues brought up on this thread.
He brought in an IO that spoke English particularly well.

Through this intermediary he explained to me quite a bit about foreigners who (1) either overstay and never come through the office again to update address or apply for an extension, (2) foreigners committing crimes, (3) foreigners who are engaged in work without proper work permit and lastly (4) foreigners who file for an extension based on marriage but are plainly not living with the named spouse nor have they been seen at that last known address for months ; thereby , effectively applying for and receiving an extension based on marriage but in reality are avoiding being on one based on retirement.

He inquired if I had anything further to discuss.
I replied that while the IO's are out and about chumming up with expats and doing home inspections that they might as well get everyone fingerprinted...should easy to do and would take less than fifteen minutes per applicant once they get with program.
The fingerprints could then be squared away with any found in the AIFIS, Eurodoc or Interpol databases from the applicants home country.
( Couldn't hurt to take throat swabs for DNA if they really want to stay ahead of the curve...unless of course micro-chipping is on the Immigration agenda. )

They stared at me in amazement and the big cheese strode out of his office returning with another IO a few minutes later.
The other IO inquired if I would like some part-time work. All three stared at me awaiting my answer.

I asked if he was serious about the offer. All three nodded their heads and the last IO said, "Very."

I dutifully replied , "Nah , you're not fooling me my friends. I'm not working unless you provide me with an extension based on working and a work Permit from the Dept of Employment (Labour)."
All three stared at me with disbelief.

After a brief pause the big cheese came over and shook my hand turning to the first IO , "Chai , I simply enjoy the way that this man thinks. Sign him up."
He turned back towards me with a big smile and both his hands clasped on mine saying , "Welcome again to stay in Thailand, Coffee."
(As I left his office I noticed he was cleaning his hand with tissues.)

I left 30 minutes later with an extension based on retirement stamped within my passport.

Next time you're in KCI you can check the balance of the details. You've been here long enough to do that, can't you ?

Everybody knows who Coffee, Mr Coffee or Teacher Coffee is. Don't you ?

It doesn't matter what name appears in your Passport or Identification...when a Thai meets you and you tell them your name - that's the name the use, isn't it ?

You don't have to make a big diggery-do about it , Croc.
By using common sense you can tell what is considered working and what is not considered working. It doesn't take a genius to figure out this out.

If they want to bust someone's balls they will, simple.

If one is not a complete arsehole, they're not going to bust your balls...nor will they ban you.

I hear what you say, but if you remember Joe was told that it was all being effected because of the bombing of the Erawan Shrine.

Anyway,

1. I have been living at the same address for over 15 years and have religiously reported my address every c. 90 days together with a Thai national who has verified same.

2. I have not been accused nor convicted of committing any crimes in any country in which I've lived/worked (other that minor traffic offences).

3. I am not and have not been engaged in any work in Thailand without the necessary permit (although I did a 3 day job in Bangkok 10 years ago that no-one (until now) knows about.)

4. Since 2001 my extension of stay has been based upon retirement.

So why will I be subjected to this ridiculous ineffective nonsense when I next decide to apply?

As an aside, how many culprits committing one or all of those 4 deadly sins have been caught since 30th June 2015?
